To Whom It May Concern:

This notice is to inform you that a public hearing will be held on Monday February 27, 2023 at 6:00 PM, Everett City Hall, 3rd Floor George Keverian Hearing Room. All interested parties may attend and opinions will be heard regarding the following petition.

Whereas a petition has been presented by:

PROPOSAL:

Interior renovations to convert a pre-existing nonconforming Three (3) unit residential structure and use to a Six (6) unit residential use.

Reason for Denial:

The existing structure, parking count and use are non-conforming. A special permit is required to extend or alter the pre-existing nonconforming use and to change the use of the nonconforming structure.

Violations:

• The existing use of the property as a three (3) family residence is nonconforming.
Section 4.B.2(b) of the Zoning Ordinance requires seven thousand (7,000) s.f. of lot area for a two (2) family dwelling. The subject property has only 4,035 ± s.f. of area and is used as a three (3) family dwelling. Converting the property to a six (6) unit residential use would constitute an extension or alteration of the pre-existing nonconforming use, requiring a special permit under Section 3.C of the Zoning Ordinance.

  • In addition, use of the property as a three (3) family residence is nonconfonning as to parking requirements. Pursuant to Section 17.A. l of the Zoning Ordinance, a three-unit residential use would require six (6) parking spaces, but the lot contains only five (5) parking spaces. Altering the use to six (6) residential units will render the use more nonconforming as to parking, requiring either a special permit pursuant to Section 3.C of the Zoning Ordinance or voluntary participation in the Transportation Demand Management program under Section 35 of the Zoning Ordinance.
  • The right side of the existing structure is less than the required Four (4) foot minimum. A special permit to change the use of a pre-existing nonconforming structure is required under Section 3.F of the Zoning Ordinance.
